No, I haven't tried it in the end - I emailed gigabyte support and got standard answer from them:
"We don't support overclocking, but it may be due to several reasons - bad RAM, bad compatibility, etc... "
I then emailed janus and waited for few weeks, until I was given the exact same bios as you found - F9H. The only problem is that in the meantime I already bought EP45-UD3P, since I couldn't wait any longer. Guess what - no problems at all - and with exact same setup (same installation of vista, same components - except for motherboard naturally) I could boot with 500+ fsb in vista.
Having settled finally on these settings:

Temperatures are awesome (overclock stable with cie and eist enabled) -with core around 35-38c in iddle, and up to 44-45c during normal load (middle 50s when priming - can be seen in picture).
So yes - the problem does indeed lie in x38-dq6 after all (at least in its bios) - and it especially affects 45nm quads - E0 revisions. When raising fsb, something goes berserk and mobo stops recognizing cpu correctly and this then raises number of problems with OS - aka "hardware failures". Seems like F9H was a step in good direction (if you got it stable at 400fsb), and we should get back to gigabyte (especially janus - I can give him his email adress at gigabyte) so that they can help us even further. After all, I thanked janus and told him that will contact him back and pass the bios/info on.
Main thing is that I'm too lazy to be arsed to get x38-dq6 back in buisness and try out this new bios. Mobo is currently lying in a closed box, but if I catch some time off work I will definately try it out.
